JUST SAY NO: Trump Administration Set To REVOKE California's Authority To Set Its Own Vehicle Greenhouse Gas Standards
Two U.S. agencies are preparing to submit for final White House regulatory review a plan to revoke California's authority to set its own vehicle greenhouse gas standards and declare that states are pre-empted from setting their own vehicle rules, two people briefed on the matter said on Thursday.

The EPA in August 2018 proposed revoking a waiver granted to California in 2013 under the Clean Air Act as part of the Trump administration's plan to roll back Obama-era fuel economy standards through 2025.

It's bigger than the 2013 waiver. California's ability to regulate fuel standards and emissions dates back in the 1960's when the Clean Air Act was passed. The act would need to be changed to really change anything regarding the State of California. This will be stopped by a court challenge and it will just be a lot of noise.

Sorry California will lose as the provision within the law which was never challenged. It will be declared unconstitutional as it allows California to enact laws that other states are not permitted to do.

No - California will win

California is only setting standards that also meet the Federal Standards as well - but address clearly identified clean air problems of their state as well. As long as their standards MEET the federal standard they are NOT in violation of the Federal law - and they do.

That is a normal procedure and there are LOTS of laws on the books in States that go beyond the Federal requirements.

Leave it alone. For one it is not worth the fight and is only being used as a political issue to drive further divisions among the electorate of the country. For another there are specific reasons that California and some of the Western states need these stricter controls (not sure mpg is the way to get there though) around weather conditions, inversions along the west coast etc...
