GM Lawsuit Uncovers Decades Of Backroom Deals Between FCA And The UAW
Beyond seeking billions of dollars in damages, General Motors' unprecedented racketeering lawsuit against Fiat Chrysler Automobiles aims to clean up the entire union-management negotiating process for the auto industry and, in reality, all of corporate America.

"This lawsuit seeks a level and honest playing field for all stakeholders in the U.S. auto industry, including manufacturers, suppliers, the UAW and employees critical to making this industry a worldwide success," the Nov. 20 lawsuit says.

But in the process, GM promises to drag FCA and the UAW through more than a decade's worth of corruption and conspiracies linked directly to the late FCA CEO Sergio Marchionne and former UAW President Dennis Williams.

The problem of course - is that the dealing have already happened - so what you are doing is asking GM to look the other way and do nothing - something you likely would not say if you were a stockholder and it cost you in value.

I would want to see how much money FCA is going to have to put in escrow for PSA - to get that deal done - that will be the true value of the lawsuit.

RICO legal cases are very hard to prove from a damages perspective. Timing is odd considering they are right up against a 4 year statute of limitations. Let GM bring it to court and see it if goes through or if it is dismissed. PG tried to take Amway and distributors to court over losses due to P&G being tied to a rumour about Satanism. The court didn't quite see it their way.

If GM succeeds with a RICO case FCA is screwed...they would end up paying 3x damages.
