Tesla Warns Fremont Workers That Unemployment Benefits Could Be Cut Off If They Don't Return To Work
Tesla told workers who don’t return to work — now that they are reopening the Fremont factory — that they might lose their unemployment benefits.

Yesterday, Elon Musk announced that Tesla was restarting production at its Fremont factory despite contrary orders from Alameda County, which is still working to approve a plan to safely reopen the factory.

Ever since the pandemic first started in the US and Tesla attempted to keep its operations going, Musk has been telling employees that if they are not comfortable going to work, they will be able to stay home without fear for their jobs.

I don't know about California, but in N.C., that is not up to the employer unless they are just paying them admin pay and it not through the state. I only own a small company... somebody had to tell him this.

If you are high risk, then you have a decision to make. Your employer has returned to work under recommended conditions. They can not be expected to harbor your fears.

Its certainly reasonable (and probably a manager's duty to preserve the employer's legal rights) to put an employee on notice that they are considered "absentee".

If the employee "calls in sick" then there is not much else to do. In NYS, the government has told employers that they cannot require doctor's notes from sick employees. If the employee says "I am sick" then they are sick.

The employee cannot call in sick indefinitely. When they are hired they are aware that they have a specified number of sick days. One more than the allowance and the employer has the option to notify the employee of the intent to terminate. We are doing precisely that.

Tesla is acting irresponsible. If the employees are being forced to work do you think the workers are going to care about the quality of the assembly of the cars? Im sure that will suffer, and the quality of their cars is already below average.

In most cases the resistance from employees returning to work stems from the fat unemployment bonus checks they are now receiving. Once that money runs out, all those "health concerns" will suddenly go away. I agree with MDarringer. If they do not return and conditions meet OSHA and CDC requirements, then the employee is vacating their job and can be terminated. Along with this the employer should send a letter to EDD notify them that the employee has been offered employment and has refused to work. Benefits at that point should stop.

For the county I live in, dealers were "reopened" without really any constraints. Of course all remained open from the get go with the exception of CarMax. We have notified all of our employees of their number of sick days remaining. We have two at one dealer that refuse to come back to work and demand to work from home. I reminded them that as the employer, WE set the working conditions and that we do not wish to engage in telework. They have been advised that we will count their absences as sick time and that we will terminate for cause when the days run out. I plan to fire both tomorrow. These deeply dedicated souls haven't realized that their log-on credentials were revoked back on Monday.
