Half Baked California Privacy Law May Keep Owners In The Dark Over Recalls
 
A privacy law in California that will allow consumers to demand that businesses delete their personal information has left some dealers questioning how to simultaneously satisfy safety standards and customers' requests.

If customers ask the dealership to delete their information, Peter Hoffman, dealer principal at Sierra Autocars in Monrovia, Calif., wonders how he'd reach customers if their vehicles were recalled.

I don't know about you but dealers ARE tasked with following up from their side too. Takata case in point. We made many calls from our side.

dealership doesnt need the information. the manufacturer does. thats where recalls originate. government should make selling that information opt in so it would stop.

THis is NOT a big deal - it will only require a small signed statement at the time of the sale. The law is really designed to keep confidential information like the info you give for a credit application - not mere contact information which the Federal Government requires be kept to inform about recalls.

Then the clause will something like - IF YOU choose to have your contact information deleted - YOU TAKE ALL RESPONSIBILITY for maintaining your vehicle, and any subsequent LEGAL liabilities. You agree to hold General Motor's Corp its agents and subsidiaries harmless in the event a recalled item fails.

That alone will have people signing a waiver - in fact it is likely insurance companies will require it
