Nissan Cracks Down On GT-R Grey Market Imports
Lawyers representing Nissan have written to a number of businesses regarding their vehicle importation activities.

The businesses in question are suspected of importing and/or offering for sale in the European Economic Area (EEA) Nissan vehicles originating from Japan and which are intended only for sale in Japan. The trademark owner, Nissan Motor Co., Ltd, has not consented to the importation or sale of these vehicles into the EEA and either of these activities would infringe Nissan's trademark rights.

These businesses have been warned not to engage in these infringing activities and, if this is ignored, Nissan will seek the support of the English courts in enforcing its legitimate rights against those businesses.

The basis of this action is well established and has been confirmed in decisions of the European and English courts over a number of years. The action does not seek to prevent individual customers or businesses from buying Nissan vehicles intended for the UK or European markets.

Gary Frigo, Nissan Motor (GB) Limited's Managing Director, said: "We have been made aware of a significant increase in activity in the import trade of certain vehicles, particularly the Nissan GT-R, which warrants immediate action."

On the subject of the new Nissan GT-R Frigo explained further:

"Nissan's number one priority is to ensure that the GT-R and its dealer network are in optimal condition to facilitate and support our customers. It will take until start of sales in March 2009 to do this. Until that time the UK will have no GT-R trained technicians, no established GT-R parts supply and, most crucial of all, the GT-R will not be covered by a manufacturer's warranty."

Nissan remains committed to providing customers with the best possible vehicles, in terms of value and specification, within the context of the regulations for safety and emissions laid down by the UK and European governments.

I recommend boycotting any manufacturer that interferes with the consumer's ability to buy anything anywhere without restrictions.

Infringing activities?!? I'm not a trade expert, but as far as I know, we do have something called "free trade" in Europe, meaning that you can sell whatever you want, whenever you want, as long as you own it! If the company in question bought the cars fair and square from Nissan and the approvals are all there (which Nissan have taken care of themselves), the company can feel free to import and distribute these cars as they own them... Sounds like Nissan is just trying to scare people out of selling Nissan's cars before Nissan... If Nissan don't want that, they shouldn't sell them the cars! This is like Nissan telling a car owner that he can't sell his used 350Z to someone they haven't approved of!
They are not selling a copied product, they are not misusing the Nissan name and they are not marketing their product as something it is not! Ergo, they are not infringing any rights...

We have importers who are doing the exact same thing with american cars here. At prices that the OEM-dealer can't possibly compete with as these parallel importers at low dollar rates in the US, while the OEM-importers are trying to sell them at over inflated prices. The american manufacturers tried to stop them, but as long as the importer can find an american dealer who are willing to sell them, there ain't a thing in this world that the manufacturers can do... Just too bad Nissan!

I don't get this as this goes directly against an EU-directive made to ensure that you can sell whatever you want to whoever you want no matter of it's origin as long as you own it!

All of Europe didn't ask Denmark to apologize... Not even after the Jesus drawings. Actually most countries were very supportive and posted the stupid cartoons aswell... I didn't personally see the point and thought it was utterly stupid in the first place, this is something muslims have very close to heart and I don't see any reason to ridicule them for that, but I'm proud of Denmark not giving in to pressure from the middle east to apologize! This happened at the hand of one man, not an entire nation, so if they wanted an apology, they should have asked him (as he did something stupid), he didn't do anything illegal (in Denmark) bt it was pretty childish and pretty stupid, however you can't expect an entire country to apologize for his work. Then what would freedom of speech be worth?!

Well... I don't exactly know what the motivation of the infamous editor was to ask the artists to draw the drawings... But I agree, it doesn't make any sence and it was only asking for trouble... He also said on a later occation that he didn't think it would make so much trouble as it did... Well... WHAT DID YOU EXPECT YOU MORON?!? YOU RIDICULE AN ENTIRE RELIGION AND EXPECT THEM TO SIMPLY IGNORE IT...

As far as I know, the idea was that it wasn't any worse than all the cartoons newspapers constantly draw of politicians and religious figures in Europe (danish newpapers have made fun at everybody from the pope to buddha)... But then again, they don't have any religious documents saying that you can't depict them... Not even the politicians! ;D

Anyway... It was a stupid thing, but it was his birthgiven right as a dane... But somehow you expect more from a grown man who run the third largest newspaper in a country, than to do something as utterly childish as this!

The same schmooze happens right here in our own North America backyard: if you are a Canadian you can not buy a new Honda, Toyota, Ford, Nissan (& others) in a USA dealership. Dealers are verboten to sell cars to non-USA residents such as Canadians and Mexicans.

Selling cars at more or less the same price all over the world would immediately stop "grey market" activity. Until German cars sell for DOUBLE the cost of the US pricing in Germany, and Japanese cars cost 50% more if purchased in the UK, nothing will change. Simple as that.

The most sensible thing for nissan to do is to refuse Servicing & Warranty for any GT-Rs purchased outside of its EU network.

So if you drive a Japan Spec GT-R into a Nissan Dealership in the UK they should just look at you and ask if you want directions to someplace else.

I know this should be against everything i stand for but .........

Ah screw it, i would still buy the GT-R and wait till 2009 to get it serviced : )

I don't understand why Nissan is so adamant about restricting GT-R sales, it's not like they'll be producing that many of them anyway.

I've seen Skylines in Canada and know of atleast 2 importers that will sell them. Why is Nissan starting now?

I think they are just affraid of loosing the newsvalue of the GT-R which will mean they will loose lots of sales in Europe. And maybe the same thing is happening here as with US cars; parallel importers buy the cars in local currency making the cars cheaper than the planned MSRP. You can buy a Dodge Charger at a 30% discount in Denmark at a parallel importer compared to the official importer... But that is ofcause a different case because of the weak dollar.
